Terms of Service

Please read these Terms carefully before using Findstead. By using our platform you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of terms

By accessing or using the Findstead platform ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Findstead Ltd, a company registered in England and Wales. By creating an account, you confirm you are at least 18 years of age and legally capable of entering into contracts.

2. Description of service

Findstead provides an AI-powered property search, recommendation, and investment analysis platform for home buyers and property investors in the United Kingdom. Our Service includes:

- Property search: AI-powered natural language and filter-based search across UK property listings. - Recommendations: Personalised property matching based on your stated preferences, buyer profile, and interaction history. - Area insights: Data on local amenities, schools, transport, crime statistics, house prices, and other neighbourhood factors. - Investment analysis: Strategy scoring (buy-to-let, HMO, flip, BRR, serviced accommodation), deal calculators, rental yield estimates, comparable sales data, and refurbishment cost estimates for property investors. - Financial tools: Indicative mortgage calculators, stamp duty calculators, and rent-vs-buy analysis. - AI chat: Conversational assistance for property-related questions. - Viewing management: Booking and tracking property viewing requests.

All property data is sourced from third parties and provided for informational purposes only. Findstead is not a regulated financial services firm, estate agent, or mortgage broker.

3. Account registration

To access personalised features, you must create an account using email and password, Google sign-in, or Apple sign-in. You agree to:

- Provide accurate and complete information. - Maintain the security of your account credentials. - Notify us immediately of any unauthorised account access. - Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are being used fraudulently.

4. Premium subscription

Findstead offers a free tier and a paid Premium subscription ("Findstead Premium"). Premium features include higher daily usage limits, unlimited investment analysis, and additional AI capabilities.

- Billing: Premium subscriptions are billed monthly via Stripe. By subscribing, you authorise recurring charges to your chosen payment method. - Cancellation: You may cancel your subscription at any time via your Profile settings or the Stripe customer portal. Upon cancellation, Premium access continues until the end of the current billing period. - Refunds: We do not offer refunds for partial billing periods. If you believe a charge is incorrect, contact [email protected]. - Price changes: We may change subscription pricing with at least 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.

5. Acceptable use

You agree not to use the Service to:

- Scrape, crawl, or systematically download property data or any other content from Findstead. - Reverse-engineer, decompile, or attempt to extract our source code or AI models. - Transmit spam, malware, or other harmful content. - Impersonate any person or entity, or misrepresent your affiliation with any person or entity. - Use the Service for any unlawful purpose or in violation of any applicable law or regulation. - Circumvent, disable, or interfere with security features of the Service, including usage limits. - Access the Service using automated tools, bots, or scripts without our prior written consent.

We reserve the right to investigate and take appropriate action for violations of these restrictions, including suspending or terminating your account.

6. Intellectual property

The Findstead platform, including its software, AI models, design, text, graphics, and all other content created by us, is owned by or licensed to Findstead Ltd and protected by UK and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal use as a prospective property buyer or investor. You may not reproduce, distribute, modify, or create derivative works of any Findstead content without our express written permission.

Property listings displayed on Findstead are sourced from third parties (including estate agents and property portals). We do not claim ownership of third-party listing content.

7. Financial and investment information disclaimer

Findstead provides financial information — including mortgage estimates, stamp duty calculations, rental yield projections, investment strategy scores, deal analysis, comparable sales data, and refurbishment cost estimates — for informational purposes only.

This information does not constitute financial, investment, or tax advice. We are not regulated by the Financial Conduct Authority (FCA) and are not a registered financial adviser, mortgage broker, estate agent, or surveyor.

You should seek independent professional advice from a qualified financial adviser, solicitor, surveyor, or accountant before making any property purchase, investment decision, or financial commitment.

Property valuations, rental estimates, strategy scores, and area statistics are estimates based on available third-party data and may not be complete, accurate, or current. Market conditions can change rapidly and past performance is not indicative of future values. Property investment involves risk, including the potential loss of capital.

8. Third-party services

The Service integrates with third-party services including Google (authentication), Apple (authentication), Stripe (payments), OpenStreetMap (mapping), and OpenAI (AI features). Your use of these services is subject to their respective terms of service and privacy policies.

We are not responsible for the content, accuracy, or availability of third-party services or external websites linked from Findstead. Links to third-party sites do not constitute endorsement.

9. Limitation of liability

To the fullest extent permitted by applicable law:

- Findstead provides the Service "as is" and "as available" without warranties of any kind, express or implied. - We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. - We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including any losses arising from reliance on investment analysis or financial information. - Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Account deletion and termination

Either party may terminate these Terms at any time.

You may delete your account at any time via the "Delete Account" option in your Profile settings or by contacting [email protected]. Account deletion will permanently remove your personal data, saved searches, liked properties, chat history, viewing requests, and all associated records in accordance with our Privacy Policy. If you have an active Premium subscription, it will be cancelled upon account deletion.

We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms, if we are required to do so by law, or if we reasonably believe such action is necessary to protect the Service or other users.

Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply after termination.

11. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via an in-app notification at least 14 days before the changes take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

12. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in Scotland or Northern Ireland (in which case you may bring proceedings in the courts of your country of residence).
